FMCSA requires post-accident testing when: (1) there is a fatality (always required), or (2) the CDL driver receives a citation AND there is bodily injury requiring off-site medical treatment, OR a vehicle must be towed from the scene. The alcohol test must be performed within 8 hours and the drug test within 32 hours. If you cannot be tested within these windows, document the reason in writing.
Never. Even if you believe you were at fault, do not admit it at the scene. Stick to factual statements only. Your perception of fault may be wrong — there could be contributing factors you are not aware of (road defects, other driver's actions before impact, mechanical failure). Let investigators and insurance adjusters determine fault based on evidence.
Most carriers require: immediate phone notification to dispatch and safety, a written accident report (company form), all photos and documentation, police report number, other party's insurance information, witness information, and cooperation with any investigation. Follow your company's specific accident reporting procedure exactly.
